DECISION

Defining functions, tasks, powers, and organizational structure of the National Center for Water Resources Planning and Investigation 

MINISTER OF RESOURCES AND ENVIRONMENT

 Pursuant to the Government’s Decree No. 123/2016/ND-CP dated September 1, 2016, defining the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to the Government’s Decree No. 68/2022/ND-CP dated September 22, 2022, defining the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Upon the request of the General Director of the ​National Center for Water Resources Planning and Investigation and the Director of the Department of Organization and Personnel.

DECISION

 Article 1. Position and function

The ​National Center for Water Resources Planning and Investigation is a public organization under the Ministry of Natural Resources and Environment, with functions of water resources planning, basic investigation, monitoring, forecasting, warning, and protection throughout the country ; providing public services on natural resources and the environment in accordance with the law .

The ​National Center for Water Resources Planning and Investigation has its legal status, seal, and bank account; headquarters in Hanoi city.

Article 2. Duties and powers

  1. Submitting to the Minister programs, schemes, projects, long-term, five-year, and annual development plans related to water resources planning, basic investigation, monitoring, supervision, forecasting, warning, and protection of natural resources according to the function of the Center; implementing these plans after being approved.
  2. Formulating and adjusting water resources master plans:
  3. a) Implementing the formulation and adjustment of the master plan on water resources;
  4. b) Implementing the formulation and adjustment of the master plan on inter-provincial river basins and inter-provincial water sources;
  5. c) Implementing the formulation and adjustment of the national master plan on protecting, exploiting, and using water resources.
  6. Conducting water resources basic investigation:
  7. a) Surveying and assessing water resources, including mapping the characteristics of river basins, characteristics of rivers, streams, lakes, reservoirs, wetlands and lagoons; hydrogeological map; water resource map, water quality zoning map, thematic maps on water resources; assessing and classifying the quantity and quality of water sources; search for groundwater sources; determining the minimum flow in rivers, water reserve areas; the ability to recharge groundwater .
  8. b) Periodically inventorying water resources and annual statistics of water resource indicators .
  9. c) Investigating the current status of exploitation, use, water resources, discharge of wastewater, and other wastes into water sources.
  10. Water resources monitoring: Establishing and and developing the national water resource monitoring network, inter-provincial and inter-national water sources; managing of the network of monitoring stations, maintaining of station facilities and monitoring equipment; measuring, collecting, and validating monitoring data; building and updating monitoring data.
  11. Water resources forecast and warning:
  12. a) Managing, synthesizing, and evaluating monitoring data quality; building modeling toolkits; supervising the implementation of integrated river basin planning; storing monitoring data according to regulations.
  13. b) Water resources forecasting and warning: forecast changes in water level, flow, total water volume, water quality, drought, water shortage, saline intrusion in inter-provincial, inter-national river basins and inter-provincial and inter-national water sources; forecasting the harmful effects caused by water; forecasting impacts of climate change on water resources; forecasting the ability to recover water when applying to manage recharge aquifer measures.

Warning the risk of depletion, drought, water shortage, pollution, and saltwater intrusion in inter-provincial, inter-country, and inter-state water sources, risks caused by water such as subsidence, bank erosion, and riverbanks.

  1. c) Compilation and provision of bulletins informing, forecasting, and warning of water resources; characteristic compilation, water resources yearbook.
  2. Carry out activities in service of water resource protection: investigate the prevention of pollution, degradation, depletion, and salinization of water sources; protect aquatic resources, supply regions, and water intake areas; ensure flow circulation; determine extraction thresholds for aquifers, assess the receiving, carrying capacity of water sources, assessment of self-protection of water sources; assess the impacts of climate change on water resources and the harmful effects caused by water; building corridors to protect water sources.
  3. Building, updating, and maintaining the water resource database system; integrating, exchanging, and providing information and data on water resources according to regulations.
  4. Applying and deploying technology for economic and efficient water use; renovating and restoring polluted, degraded, and exhausted water sources.
  5. Investigation, geothermal research, hot water, mineral water and basic engineering geological investigation, geodynamic phenomena of works, and geological hazards related to water as assigned by the Minister.
  6. Participating in developing a water resource strategy, a master plan for a basic investigation of water resources; standards, technical regulations, and economic-technical norms on planning, investigation, assessment, monitoring, forecasting, warning, and protection of water resources.
  7. Giving opinions on projects of investigation and planning of regions, provinces, and centrally-run cities, technical plans, specialized in exploiting and using water resources and discharging wastewater and waste into water sources.
  8. Performing service activities in the field of natural resources and environment, including planning, investigation, assessment, search, exploration, exploitation, use, monitoring, and forecasting of water resources; assessing the impacts of climate change on water resources; renovating and restoring the polluted, degraded or exhausted water sources; mineral investigation, survey, and exploration; geological engineering survey, geotechnical; cartography; discharge investigation and environmental impact assessment; analysis and testing of water and soil samples; design consultancy, supervision, appraisal, and technology transfer; manufacturing, assembling, importing, exporting and supplying materials, equipment, technology products, and other services as prescribed by law.
  9. Implement research programs and topics, and apply and transfer science and technology on water resources.
  10. Technical training for planning, investigation, assessment, monitoring, forecasting, and protection of water resources as assigned by the Minister.
  11. Implement international cooperation in the field of water resources as assigned by the Minister.
  12. Financial and asset management of the Center; carry out responsibilities as level II cost estimate center for units under the Center under the law.
  13. Organize the implementation of administrative reform according to the executive reform program and plan of the Ministry.
  14. 18. Manage the organization, apparatus, employment positions, and structure of public employees according to professional titles and the number of unit employees as assigned by the Ministry and according to the provisions of law.
  15. 19. Statistics, periodical and irregular reports on the performance of assigned tasks.
  16. Perform other duties as assigned by the Minister.

Article 3. Center Leader

  1. The ​National Center for Water Resources Planning and Investigation has a General Director and up to 03 Deputy General Directors.
  2. The General Director is responsible to the Minister for the assigned tasks and is responsible before the law for all activities of the Center; stipulate the functions, duties, powers, and organizational structure of the organizations under the Center.
  3. The Deputy General Director assists the General Director and is responsible to the General Director for the assigned fields of work.

  3. 3. Department of Science, Technology and International Cooperation.
  4. 4. Department of Water Resources Planning.
  5. 5. Department of Water Resources Investigation.
  6. 6. Northern division for water resources planning and investigation.
  7. 7. Central Vietnam division of water resources Planning and Investigation.
  8. Division of water resources Planning and Investigation for the South of Vietnam.
  9. Center for Water Resources Warning and Forecasting.
  10. Center for Water Resources Quality and Protection.
  11. Water Resource Technology and Data Center.

Offices and units from Clauses 6 to 11 are level III estimating units, have their seals, and can open accounts at state treasuries and banks under law.

Article 5. Transition Terms

The Water Resources Engineering and Technology Center and the Water Resources Data Center will continue to operate under current regulations until the Decision defining the functions, tasks, powers, and organizational structure of the Water Resource Technology and Data Center is promulgated and takes effect.

Article 6. Validity and responsibility for enforcement

  1. This Decision takes effect from November 1, 2022. It replaces Decision No. 1268/QD-BTNMT dated May 25, 2017, of the Minister of Natural Resources and Environment, defining the functions, tasks, powers, and organizational structure of the National Center for Water Resources Planning and Investigation.
  2. The Chief of the Office of the Ministry, the Director of the Department of Organization and Personnel, the General Director of the National Center for Water Resources Planning and Investigation, and the heads of agencies and units under the Ministry are responsible for the implementation of this Decision./.
